These Terms of Service ("Terms") form the agreement between you and Hostingoor, a company registered in England and Wales under company number [Company number], whose registered office is at [Registered office address] ("we", "us", "our"). They apply to every service you order from www.hostingoor.com, including web hosting, reseller hosting, email, SSL certificates and domain names (the "Services").
1. Who can use our Services
You must be at least 18 years old and able to enter into a binding contract. If you order on behalf of a business, you confirm that you are authorised to accept these Terms for it. You are a "consumer" if you order for purposes wholly or mainly outside your trade, business, craft or profession; some sections below apply only to consumers, and nothing in these Terms affects your statutory rights as a consumer.
2. Your account
- Keep your account details accurate and up to date, in particular your name, postal address, email address and telephone number. Domain registries require correct registrant details.
- Keep your password secret and turn on two-factor authentication. You are responsible for everything done through your account.
- Tell us straight away at [email protected] if you think someone else has accessed your account.
3. Orders and the contract
When you place an order you make an offer to buy the Services. The contract is formed when we accept your order by activating the Service or confirming it by email. We may refuse an order, for example when we cannot verify your identity or payment, or when the order breaks our Acceptable Use Policy. If we refuse an order after taking payment, we refund you in full.
4. Prices, VAT and payment
- Prices are shown on our website in the currency you choose. We are not currently registered for VAT, so no VAT is added to our prices. If this changes, VAT will be shown before you pay.
- Prices shown in a currency other than our base currency are converted with current exchange rates; the amount on your invoice is the amount you pay.
- Services renew automatically at the end of each billing period. We send a renewal invoice before the due date and a reminder before we take any automatic payment.
- If an invoice is not paid, we may suspend the Service and later terminate it, as described in our billing reminders. Domain names that are not renewed expire and may be lost.
- We may change our prices. A new price applies from your next renewal, and we will tell you at least 30 days in advance. If you do not accept the change you can cancel before the renewal.
5. Your right to cancel
Consumers have a statutory right to cancel within 14 days. How this works, and when it does not apply (for example to domain registrations), is explained in our Refund and Cancellation Policy, which forms part of these Terms.
6. Using the Services
You must use the Services lawfully and in line with our Acceptable Use Policy. You are responsible for the content you host, the email you send and the software you install, and for keeping your own websites, plugins and passwords secure.
7. Availability, maintenance and backups
- We aim to keep the Services available at all times but cannot promise that they will be uninterrupted or error-free. We carry out planned maintenance at quiet times and give notice where we reasonably can.
- We take regular backups for our own disaster recovery. They are not a substitute for your own backups: please keep copies of your website, databases and email.
- Resource limits (disk space, bandwidth, CPU, mailboxes and similar) are listed on each plan. "Unlimited" features are subject to fair use so that one account does not affect others on the same server.
8. Data protection
We handle personal data as described in our Privacy Policy. Where you store personal data of other people on our servers, we act as your processor under the Data Processing Agreement.
9. Suspension and termination
You can cancel a Service at any time from your client area; it ends at the end of the paid period unless you ask for immediate cancellation. We may suspend or terminate a Service if you seriously or repeatedly break these Terms, if your use puts our network or other customers at risk, if we are required to by law or a court, or if invoices remain unpaid. Where reasonable, we warn you first and give you time to put things right. After termination we may delete your data, so please download it before the Service ends.
10. Our liability
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
- Consumers: we must provide the Services with reasonable care and skill. If we do not, you may be entitled to a repeat performance or a price reduction under the Consumer Rights Act 2015. We are not responsible for losses that were not foreseeable, or for business losses.
- Business customers: we are not liable for loss of profit, revenue, business, goodwill, data or for indirect or consequential loss, and our total liability in any 12-month period is limited to the amount you paid us for the affected Service in that period.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as failures of power, networks or third-party suppliers, attacks, natural disasters or acts of government. We will tell you and do what we reasonably can to limit the effect.
12. Changes to these Terms
We may update these Terms to reflect changes in law, our Services or the way we operate. We will tell you about material changes by email or in your client area at least 30 days before they take effect. If you do not agree, you may cancel the affected Service before the change takes effect.
13. Notices
We contact you by email at the address on your account and through your client area. You can contact us at [email protected], by telephone on [Telephone], or by post at [Registered office address].
14. Complaints and disputes
If something goes wrong, please follow our Complaints Procedure so that we can try to resolve it quickly.
15. General
- These Terms, together with the policies linked from them and your order, are the whole agreement between us.
- If a court finds part of these Terms invalid, the rest stays in force.
- You may not transfer your rights under these Terms without our consent. We may transfer ours to another organisation, and will tell you if this affects you; if you are unhappy you can cancel.
- Only you and we have rights under these Terms; the Contracts (Rights of Third Parties) Act 1999 does not apply.
- These Terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts and the mandatory consumer law of your country of residence still protects you.
